UN experts in Geneva, Switzerland (“A disturbing pattern of legislative activity hostile to ethnic minorities and immigrants”) . . . South African Nobel Peace Prize winner Desmond Tutu (who comparies it with apartheid) . . . Cardinal Roger Mahony of the Archdiocese of Los Angeles (likening it to the “police state tactics of Nazi Germany and Communist Russia” and calling it “the country’s most retrogressive, mean-spirited, and useless anti-immigrant law”) . . . They all think that your new pet law, SB-1070, well, basically sucks.
A lot of us think so too. Keep boycotting, America.

Two questions….
What power does an Arizona law enforcement official have under the new Arizona law that a federal law enforcement official in Arizona did not already have?
What type of identification does a non-citizen have to carry in Arizona under the new Arizona law that the very same non-citizen did not already have to carry under the already existing federal law?
Help me out here.

Actually, Blackfon, the Feds have the right under federal immigration law to stop anyone on the suspicion that they are here illegally while the AZ law requires that such enquiries can only be made subsequent to a non related to immigration lawful contact by police.
Wow, if these people hate the AZ law they must passionately despise the many decades old federal law!

Actually, Blackflon — and this is my site, so I can say whatever I want!!! — I think the conservatives will see that states don’t have the right to enforce federal immigration law . . . when the courts speak, that’s how it will play. Taking bets — any takers?

Calm down Julie. No one said you coudn’t say anythiing you wanted to say.
The Arizona law and the Federal law are different in several ways.
So they would not be enforcing the Federal Law.
But as you say, we will let the courts make the final decisison.

Blackflon, I was just kidding . . . but actually, it’ll be interesting to see how it plays out. Now, with President Obama meeting with Gov. Brewer, even more interesting . . . don’t think he can win with this one. The libs are screaming about him working with Brewer, the right will scream if they modify the AZ law.

Julie, the law goes into effect on July 29th. Then all hell will break loose the first time some Mexican gets stopped and the lies will flow.

I’m a lib, so I think racial profiling is a bad thing. You’re not, so you probably see it as justified to stop the flow of criminals across the border. I see both sides, but I belive civil rights trump all else.

Why do people keep saying it is racial profiling? The law has not even taken affect yet.
Also, within the law itself racial profiling is specifically not allowed.
People are profiled everyday in this world. It’s not a new concept.

Stay with me here . . . when the cops stop someone and the ONLY criteria is “race, ethnicity, religion or national origin,” it is racial profiling. Cops do it every day, without a law endorsing it; let’s imagine a world in which cops can do it with the full endorsement of the law. Uggh.

Julie, under the new Arizona law, police officers are not allowed to simply stop someone because of the criteria you mentioned.

My prediction is that SCOTUS will uphold Arizona’s law and it will likely be a unanimous decision. The arguments before the court will not be about whether or not the law is effective or whether it is good or bad policy. It will hinge upon precedence and there’s a long history of court rulings that favour Arizona’s right to enforce its borders and federal law.
There’s an entire library of federal laws that individual states have copied so that they can both enforce and adjudicate them within their own systems for expediency. Because Arizona’s statute is essentially identical to the federal one, and because federal law does not expressly ban it, there’s no legal or constitutional basis to overturn it… unless the federal law, itself, is overturned. That’s just not gonna happen.
